National Insurance Company Limited in Sector 17, has been directed by the UT Consumer Forum to pay Rs 20,000 for a dead cow insured with them, whose insurance claim the company had, earlier, dismissed.
Jas Inder Singh, resident of Faridkot district, purchased cows under the High-tech Dairy Scheme of Government of Punjab in September 2011. He alleged that the insurance company never supplied the terms and conditions of the policy, however, the health certificate of the insured cows was issued. He said that one of the cows died in the same month and upon intimation of the same, an investigator was deputed by the insurance company. A post mortem examination of the animal was conducted and necessary documents were submitted by the complainant.
The company, however, dismissed the claim stating an exclusion clause that the company was not liable to pay the claim in the event of death of the insured animal due to disease occurring within 15 days from the commencement of risk. The said animal had died within 12 days from the commencement of the policy.
The company, though, could not prove on record that they had supplied the terms and conditions of the policy to the complainant and in these conditions, it was established that the complainant was not aware of the exclusion clause. It was further noted by the forum that the animal had died due to respiratory failure caused by tympony, which is not a disease.
The company now has to pay the complainant Rs 20,000 along with an interest of 12 percent per annum from the date of repudiation of the claim. Additionally, the insurer is also directed to pay a sum of Rs 2,500 as costs of litigation.
