Israeli national Nurit Toker,booked by the Mumbai police for allegedly carrying two live cartridges in her backpack while travelling from Mumbai to Kathmandu,has moved the Bombay High Court,stating that she had recently completed her compulsory training in the Israeli army and the cartridges were her personal ammunition.
Toker has urged the court to quash the FIR filed against her by the Sahar police under Sections of the Arms Act,1959.
Her counsel Haresh Jagtiani and Niteen Pradhan told the court that Toker,22,who completed her three-year training on October 10,had come to India for a holiday. Toker stated in her petition that the cartridges compatible with her M-16 assault rifle was acquired during her military training. She had,however,not carried the rifle.
Jagtiani also told the court that no objection was raised against the cartridges when she flew out of Israel on October 26 or when she landed in Mumbai a day later. It is only on October 28 while Toker was about to board a Jet Airways flight to Kathmandu that the CISF intercepted her.
Additional public prosecutor Aruna Kamat-Pai,however,told the court that the CISF was not made a respondent in the case. Justices A M Khanwilkar and R G Ketkar asked the Central agency to be joined as a respondent. Pradhan also told the court that Tokers tourist visa was going to expire on December 5. However,her passport issued in Jerusalem,which was impounded by the police,should be returned to her so that she does not violate the Foreigners Act by staying in the city without a visa.
