Rebuking the UT Administration and the Central government for causing inordinate delay in the construction of the Sector-43 Judicial Complex,the Punjab and Haryana High Court has directed the UT Administration to resume the work immediately.

The construction of the Rs 18-crore project has come to a halt since April this year due to non-availability of funds. A division bench comprising Chief Justice Tirath Singh Thakur and Justice Mahesh Grover made it clear to the Administration that the work must resume with immediate effect and asked the Administration to arrange funds on its own.

The Bench refused to entertain the alibi of the UT Administration wherein it stated that a dispute had arisen between the Administration and Central government over the issue of funds. Terming it as “an internal matter”,the Bench asked the Administration to either manage funds on its own or arrange the same from the Home Ministry.

While the Central government has refused to bear additional expenditure on account of additional costs to be borne over Rs 18 crore,the Administration has taken the plea that it does not have the financial power beyond Rs 10 crore. The counsel for the Centre today informed the High Court that Rs 3 crore had been released to the UT Administration. The Bench has also directed the Ministry of Law and Justice to release the remaining Rs 5.6 crore from the total estimated cost of Rs 18 crore within six weeks.

The Finance Secretary of Chandigarh Administration has been directed to file the status report of the progress from today onwards till January 2010. The court has made it clear that if the status report is not filed by January then the Finance Secretary will remain present in the High Court on the next date of hearing. The court,on the next date of hearing,will also consider the additional amount to be incurred on the chamber for advocates to be constructed in the new premises in Sector 43.
