Suspended Himachal Pradesh MLA from Doon Assembly constituency, Ram Kumar Chaudhary, who allegedly carried out the murder of Hoshiarpur girl Jyoti Kumari on November 22, was remanded to judicial custody by a local court here.
After hearing the prosecution and defence sides of the case, Duty Magistrate Kanwal Kumar remanded Chaudhary to 14 days of custody here.
The court turned down the prosecution's plea for two more days of police remand in the case after the arguments by defence counsel A S Sukhija in the case that the police had earlier sought the remand of only two days for making recoveries which ended on Sunday.
Sukhija also moved an application for providing B-class facilities to Ram Kumar Chaudhary at the prison, saying that he is a legislator besides a well-qualified person.
"After hearing the arguments in the case the court sent the application to prison authorities," said Sukhija. The counsel for the accused also cited his qualification - a Masters in Public Administration - as one of the reasons for giving him "better" facilities at the prison.
Public prosecutor Surinder Bairagi said that the application for police remand was moved before the court to make the recovery of a mobile phone. "The court however turned down the request," he said. Police investigations earlier revealed that the MLA was in touch with the girl on his cell phone and in fact its location has also been allegedly traced to Sector 21 where the girl was found murdered with her head crushed under a truck.
Police earlier said that the MLA had even submitted fake documents to get the SIM cards to stay in touch with the deceased girl.
The application for allowing the MLA to take oath by producing him before the Speaker of Himachal Vidhan Sabha was listed for hearing on January 22.
