Kargil hero’s father wants Pak apology for torture, moves SC

The father of Kargil martyr Captain Saurabh Kalia, who was reportedly subjected to brutal torture in captivity by the Pakistan Army, has moved the Supreme Court, seeking a direction to the Centre for taking up his son's case in an international judicial forum.

In his petition to the SC, N K Kalia, a retired scientist, has asked the government to get Pakistan to apologise for the incident that went against all norms of the Geneva Convention that charts out protocols for the treatment of prisoners of war. Kalia has contended that the ministries of External Affairs and Home Affairs should ask International Court of Justice to expose the torture that resulted in his son's death. He has sought a directive to the government to exert pressure on Pakistan to identify and punish those Pakistani soldiers who indulged in the barbaric torture of his son.

Kalia has alleged that the attitude of the government in not responding to various representations made by him for appropriate action against the Pakistan government at the international forum, has forced him to approach the SC to bring justice to the Indian soldiers who were subject to war crimes by Pakistan.

Immediately after getting commissioned into the 4 Jat Regiment, Saurabh Kalia was posted in Kargil. In May 1999, he had gone out for patrol duty in Kaksar area along with five others. They were reportedly caught by the Pakistan Army, which kept them in captivity for over 22 days and allegedly subjected to brutal torture as evident from their bodies handed over by the Pakistan Army on June 9, 1999.
