Kasab’s lawyer removed from Islam Gymkhana

    Kazmi's appointment as a trustee of Islam Gymkhana was terminated this week.

    Shortly after being criticised by the Shia community for defending Mumbai terror accused Mohammed Ajmal Amir Kasab, lawyer Abbas Kazmi has been removed as a trustee from the prestigious Islam Gymkhana on the same ground.

    Kazmi's appointment as a trustee of Islam Gymkhana was terminated this week on the ground that defending a terrorist was against the essence of Islam.

    This is the second instance where Kazmi has been criticised after he took up Kasab's case. A few days back, Muslim Ulemas, clerics and scholars had said that "by calling himself a Shia community member, Kazmi has given an impression that he is the leader of Shias".

    Gymkhana sent Kazmi a letter saying "you have agreed to defend the most dreaded terrorist Kasab. This is against the essence of Islam. There is no place for terrorism in Islam and also no scope for any defence of a terrorist. To maintain Gymkhana's integrity, your trusteeship is being terminated".

    Reacting sharply to the Gymkhana's decision, Kazmi said that "this smacks of political vendetta. The gymkhana is not a Muslim body but an association of persons. How can they say that defending an accused was against the essence of Islam"?

    "I am performing my professional duty. Accepting Kasab's brief has nothing to do with Islam. The court has appointed me to take up Kasab's case and I have followed the directive".

Obviously their understanding of democracy, court process and natural justice principle is non-existent. I think there should be more support for Mr. Kazmi from the public.

The problem is not with you but with the society in which you live in. Islam never advices to hamper the process of Justice. There have been cases when Caliphs have had to change their decisions and they had always given full opportunities to plead the guilty their cases. Process of allowing Witnesses to present and corroborate their observations was critically important in all decisions. There are people who are unaware of International Law and its ramifications, Modern Jurisprudence and the Moral Conduct of a civilized nation. These Gymkhanas are the remaining vestiges of British culture. Earlier their membership was a symbol of prestige and honor. However, the new found wealth of Young India have begun to ignore them and Five Star Hotels have become the new hub of social activities - an indicator of status. The minds of the members of these old institutions are set in the grooves. These worthy office bearers if I.G. can't speak against the court which has appointed Abbas as the defender of Kassab. If the court doesn't provide a lawyer, the case can't proceed. Stagnancy factor goes in favor of Kassab. Court has another choice - call a lawyer from Pakistan or any other country to defend Kassab. It would have been tantamount to opening another Pandora Box. Without going into the intricacies of law these critics unload their emotional blathering upon the person who had shown the courage to stand up for the principles. He had not volunteered to defend him. The fate of Kassab is well known to everyone. He can't escape. The die is cast. Islam Gymkhana may have scored a point or two in line with Shiva Sena or MNS but its decision is not sagacious. It would be a Kangaroo Court if Kassab is executed without a fair trial. Those who are asking not to defend him are not doing any great favor to the nation. If it not Abbas Kazimi someone else has to defend Kassab for the sake of principle of a civilized nation !
