Man behind anti-Modi SMSes gets bail

As the parties did not press for a written order, Justice Z K Saiyad, in whose court the plea was heard, gave an oral order and granted bail to Patel on a surety of Rs 10,000.

Justice Saiyed, however, criticised the police for showing undue zeal in applying sedition charges against Patel.

During the course of the hearing, Justice Saiyed asked the police

officers: 8220;Have you read the section that describes sedition?8221;

At another point he told the police: 8220;If these SMSes amount to sedition, then anything the electronic and print media says against the government, is also sedition. By this measure, even they should be put behind bars.8221;

Patel, the city general secretary of the VHP, was arrested on October 27, for allegedly sending a stream of more than 4,000 SMSes, accusing Modi and his government of going soft on terrorism and diverting from the core values of Hindutva.

The SMSes were sent to other VHP members, as well as to media persons. Besides sedition, Patel has been booked under a host of other provisions of the Indian Penal Code IPC that includes forgery, inciting communal violence and disrespect to religion.

Patel has been associated with the VHP for the last 15 years. His earlier bail plea before the Gandhinagar Sessions Court was rejected on November 12 on the ground that the investigation in the case was still on.
