    One of the abiding tragedies of modern India has been that the Babri Masjid dispute could never be dealt with within a forensic legal framework. The central proposition of a constitutional democracy, that law must be allowed to take its own course, rang hollow when law was not taking any course. That the dispute itself languishes in courts, decades after it was originally instituted, is itself testament to the limited power of the law in framing this dispute. In the meantime every single political entity acquired an investment in keeping the dispute alive. The Congress ran with the hare and hunted with the hound by allowing shilanyas on the site (read Narasimha Rao’s account of Buta Singh’s conduct as home minister). Many secularist parties were less interested in finding a solution than in using the dispute to display their credentials, and many groups used the dispute to politically use minorities. Ayodhya, to borrow Emily Dickinson’s phrase, became the narcotic that nibbled away at India’s soul.

    None of this context can detract from the central culpability of the BJP and the Sangh Parivar in the destruction of the mosque. The destruction was a denouement of a movement that baited minorities and left death and destruction in its wake. The only question was whether the Liberhan Commission could translate culpability into a forensically legal framework. This remains to be seen. On the face of it there is very little surprising in the revelations in relation to the BJP. When it came to the BJP it was politically convenient for all of us to hold on to distinctions without a difference. What did the distinction between saying the movement and the frenzy was planned but the destruction was not amount to? Even Rao acknowledged that the BJP leaders were pleading with the kar sevaks to stop. But that was like trying to stop an already fired bullet in mid air. Even Vajpayee’s self-exoneration, personal decency and expressions of regret were always compromised by the fact that his government did not give the slightest evidence of pursuing the perpetrators of this enormous crime. The BJP tried to dissociate itself from the act, while continuing to nurture the actors. The surprise is not in the revelations. The surprise is in our feigning surprise. For if all this is true, the report actually indicts our democracy. We were the ones trying to hold on to the ceremonies of innocence, so that we could allow a space where Hindutva was politically acceptable, but no one had to own up to its consequences.

    Undisputed vandalismBy: ashok | 26-Nov-2009 Reply | Forward To carry Mr. Mehta's argument a little further, why is it that even the harshest critics of the demolition of a four hundred and fifty year old mosque, too long in existence to be regarded as a " disputed structure ", do not call for its restoration ? The two national parties have found different ways to mine the same raw emotions for electoral advantage.

I believe that from a legal standpoint, it is almost a 'slam dunk' case given history and religious relevance and offers to make cash settlement. It was deliberately kept in the purgatory since a verdict would be too inconvinient vis-a-vis Muslim sentiment. There were two wrongs here (i) the 'in the begining' mule headedness of the Muslims and (ii) 'the aftermath' of Hindutva Kar Sevak movement resulting in conniving for its destruction. These are equal and opposite forces, the two faces of a political coin. Fortunately, the Hindus realized the folly of the Hindutva (instead of Indianess) and the debauched nature of the secondary rung of the Hindutva leaders in BJP/VHP. Good riddance in the last elections. The inability of the Muslim leaders to concede to Hindus sentiments continues. A smarter polity would have settled, else expect deja vu.

No need to go to back to Hindutava as a movement, we remain Hindus and behind BJP in downtimes also...
    Good ArticleBy: karan | 25-Nov-2009 Reply | Forward Almost all Hindus barring our secular vote-bank politicians supported this demolition which was a symbol of BARBARITY.Whether people like it or not but Islamic invasions and the HINDU/Buddhist/SIKH genocides did happen.Temple destruction and building of mosques on the exact site was a symbol of domination of ISLAM over idol-worshipping HINDUS.Hindus are not asking to tear down all the mosques that would be truly "COMMUNAL".They are asking only the sites which are important to their sentiments.The sentiment still exists overwhelmingly among the hindus.Mucking with Ayodhaya will propell a more powerful reaction than previously.Plus the blatant dishonesty of Congress and its using CBI and law just as another tool to settle scores is the most open secret today.Congress is best served to keep its dirty hands off such issues.
    good which came out of the movement also needs to be consideredBy: N J Ramesh | 25-Nov-2009 Reply | Forward Forensically legal framework would certainly have been useful, but the good which came out of Rama Janma Bhoomi movement also needs to be considered. We need to begin by examining whether it was really a movement and what its social significance was in the wider national context. It gave rise to a stable political alternative, a nuclear state, a rapid thrust in economic growth rate, a powerful paradigm for regional peace with Pakistan which was ofcourse undermined by external forces and derailed democracy in Pakistan, and equally signficant, a bulwark to effectively counter Phillipinisation of Bharat. While paying due respects and heeding in letter and spirit to Liberhan findings, let this be an opportunity for BJP to weedout the ribald elements and build upon its splendid achievements.
