Nandigram: HC discharges CPM leaders from contempt proceedings

The Calcutta High Court on Friday discharged CPM state secretary Biman Bose and party leaders Binoy Konar and Shayamal Chakraborty from contempt proceedings initiated against them in January 2008,following their alleged remarks against the judiciary after the High Court’s verdict on the Nandigram firing incident.

A Division Bench comprising Justices Bhaskar Bhattacharjee and Prasentjit Mondal held that the suo motu criminal contempt proceedings against the three leaders were not in accordance with law. 

The three leaders had allegedly made remarks against the judiciary at a rally in Esplanade on November 17,2007,a day after the Calcutta High Court had announced its verdict on the Nandigram incident. The High Court had ruled that police firing at Nandigram,which claimed 14 lives,was illegal.

Following this,the Bar Association of the Calcutta High Court had apprised the Division Bench comprising former chief justice S S Nijjar and Justice Pianki Chandra Ghosh on the alleged remarks.

The Division Bench had drawn suo motu criminal contempt proceedings against Bose,Konar and Chakraborty in January 2008.

The Division Bench also said that the remarks passed by the three leaders had been published in various newspapers and other media sources and that the Court did not issue contempt rules against them.

As nearly a year has passed since the alleged remarks were made,there is no scope for the Bench to draw contempt proceedings against those media sources,held the Bench.
