National Insurance Co to pay Rs 51 lakh compensation in mishap case

The parents of a software engineer who died two years ago in a road accident, have been awarded a compensation of over Rs 51 lakh by a motor accident claims tribunal (MACT) here.

MACT presiding judge Arun Bhardwaj directed National Insurance Company Ltd with which the offending vehicle was insured, to pay the compensation.

26-year-old Vikrant Sharma, who was a software engineer in Bangalore-based Accenture Services Pvt Ltd, had died on November 6, 2010 when a Baleno car in which he was travelling with his three friends had gone out of control and hit a road-side barrier near Gurgaon in Haryana.

According to the complaint of victim's parents, the car had gone out of control as it was being driven rashly while Vikrant fell out of the car and suffered grievous injuries. He was rushed to a nearby hospital where he was declared brought dead.

During adjudication of the plea, driver Ankur Raj Singh, denied his liability saying he could not remember who was driving the car as he has been suffering from amnesia after the accident.

The tribunal, however, rejected Singh's contention saying while making the insurance claim for damage to the vehicle, he had admitted that he was driving the car.

It also said he had not shown any medical evidence to prove that he is suffering from amnesia.

"Total compensation payable to petitioners would be Rs 51,38,102... Insurance company has not proved any defence.

Therefore, the compensation would be paid by it," the tribunal said.
