Neeraj Grover case: Owner moves HC for nod to sell flat

Desperate to get rid of the ill-fated property where media executive Neeraj Grover was killed in 2008,Shivani Atri,the owner of the apartment which had been rented by Kannada starlet Maria Susairaj,has moved the Bombay High Court seeking permission to sell the property.

Stating that the property has buyers and that the family was eager to sell the property,the Atris have moved an application seeking revocation of the trial court order.

The trial court in July,this year,while convicting Susairaj and her former Naval officer fiancé Emile Jerome had stated that “two keys of the flat be returned to the owner Shivani Atri on executing a personal bond of Rs 2 lakh.”

However,it continues to state that “She (Atri) shall preserve the flat,till the period of appeal and in case if appeal is filed then,till disposal of appeal.”

While Jerome was found guilty of culpable homicide not amounting to murder,Susairaj was convicted only for destruction of evidence. Susairaj was released soon after the judgement as she had spent the three years of rigorous imprisonment behind bars.

Both Susairaj and Jerome were acquitted of the murder charges.

According to the prosecution Atri’s flat no: 201/ B in Dheeraj Solitaire building at Malad was rented out to Susairaj,where Grover was killed.

The State has moved against the lower court’s order and has sought graver punishment for both the accused.

It was not an easy task for the Atris to get the keys back. After several applications,the trial court had directed permission to hand over the keys. “The house is around 650 sq. feet and would easily cost Rs. 70 lakhs. It has got many potential buyers. But the deal cannot be struck until the court grants permission,” said a real estate agent. Susairaj,too had landed in this house through an agent.

The Atris,a NRI family,who shuttle between Mumbai,Dubai and London,had bought the property a few year ago,availing a bank loan.

“The idea was to earn the installment money through the rent amount. However,with the incident they lost out on the rent amount and continue to pay the EMI. It would be a distress sale,but the family wants to get rid of the property,” said their lawyer Parvez Memon.

“They had rented their property to someone. Why should they pay a price for someone else’s deeds?” Memon said.
