New anti-terror Acts to be in line with UAPA Act: Govt

    Centre said anti-terror Acts should be in line with Unlawful Activities (Prevention) Amendment Act.

    The Centre on Wednesday said anti-terror Acts like GUJCOCA, enacted by state governments, should be in line with the Unlawful Activities (Prevention) Amendment Act as there has been a change in government policy.

    Minister of state for Home Affairs Mullappally Ramachandran said in Rajya Sabha that the assent to the Maharashtra Control of Organised Crime Act, 1999 (The Maharashtra Act No. XXX of 1999) was given on April 24, 1999 presumably in accordance with the then policy of the government.

    "Subsequently, there has been a change in the policy of the Central government and it is of the opinion that all subsequent state Acts should be in line with the Unlawful Activities (Prevention) Amendment Act, 2008, as approved by Parliament," he said replying to a written question on the reasons behind refusal to give assent to GUJCOCA, 2003.

    The Centre has also advised amendments to the Gujarat government in this regard.

    The law and its effectiveness.By: Jem Hassan | 09-Jul-2009 Reply | Forward There is no scarcity of laws anywhere in the world for curbing or fighting terrorism...but it is important to know the purpose behind making a law.It shouldn't be just for political stunt as Gujju CM Modi does....it was his state which dicriminately approach people just on the base of their faiths.So the concern extended by the centre is quite understandable on the intension of a state govt which always had a blind eye on Hindu extreimists and iron fist even on innocent Muslim youngmen.Treat everyone with equal justice...no terrorism will be bred by anyone...19 bombs have been recovered from Gujarat and some of them placed even on trees by Modi's police few months back...it was as if the police knew all the places where the bombs were planted...Modi is well known for his trechery and indecency as a politician...that's why Indians voted Congress again to power aoon they heard from some corner that Modi is in the run for PM post after Advani...we dont need any risk at this point...

The special treatment of Maharashtra in regard to the UAPA Act smells of partisanship. If the Maharashtra Control of Organised Crime Act is still valid, either amend the UAPA Act to make it more meaningful and comprehensive like in Maharashtra or allow individual states to design their own law, with the UAPA Act as a guideline. Don't find yourself deficient at a later date. The key is to effectively control unlawful activities, whether in Maharashtra, Gujarat, Delhi or anywhere else.
