After Aseemanand retracted from his earlier confessional statements at Panchkula on May 12,the National Investigation Agency (NIA) had wanted to interrogate him again for two days. The NIA court of Additional District and Sessions Judge Subhas Mehla had allowed it,with a condition that the questioning will have to be carried out in the presence of his lawyer,Manbir Singh Rathi. However,the NIA team failed to reach the Central Jail at Ambala on the two days fixed for questioning. Aseemanand is currently in judicial custody.
The NIA had moved an application through Inspector Amod Kumar stating that on the basis of the revelation made by Aseemanad,the probe team has conducted investigations at several places,including Delhi,Madhya Pradesh,Gujarat,Maharashtra,Jharkhand and during extensive investigation some important issues had come to light that needed further clarification and corroboration by Aseemanand. His examination /questioning is essential for clarification of some facts/queries, said the NIA application.
The court ordered,The team of officers constituted by the NIA,New Delhi,is allowed to examine/ question accused Aseemanand in Central Jail,Ambala,in the presence of his lawyer Manbir Singh Rathi on 14/5/2011 and 15/5/2011 between 9 am and 5 pm.
On May 14 and 15,two officials of the NIA were present at the jail,waiting for a team from Delhi,which failed to arrive.
This shows the seriousness of the NIA. Despite getting time,their team failed to reach, said Rathi.
The interrogation was important as Aseemanad had submitted in the court that the CBI,NIA and Rajasthan ATS forced him to confess and that the CBI had tortured him physically and mentally,obtained his signatures on blank papers,and that his statement on November 19,2010 before a magistrate was dictated by them. He had submitted in the NIA court that he had given statement before the Chief Judicial Magistrate,Panchkula,on January 15,as dictated by the investigation team of the NIA under threat that he would be implicates in various false cases. He had alleged that the Rajasthan ATS had forced him to become an approver in Ajmer blast case.
