Nirmal Yadav case: Framing of charges delayed further

The framing of charges in a bribery case involving retired Punjab and Haryana High Court judge Nirmal Yadav was delayed further after the defence counsel moved an application demanding photocopies of the records submitted earlier by the Union Ministry of Law and Justice. The counsel for the CBI has sought time to respond to the application. The next hearing of the case will now be on February 2.

The records pertain to sanction of the prosecution against Yadav. The Ministry of Law and Justice had submitted the records in the Special CBI court on December 8. The defence counsel had then sought time to examine the records.

The defence counsel in his application stated that since the record was very voluminous, photocopies of the same would be required. The defence counsel also requested that the photocopies of the records that were submitted by the CBI in November pertaining to the sanction of prosecution last year in a sealed cover be opened.

The Special CBI court had on November 10 issued notices to the registrar of the Supreme Court and secretary (justice), Union Ministry of Law asking them to provide the entire record pertaining to sanction of the prosecution that was in its possession.

The reply by the Additional Registrar, SC, dated December 29, 2012, that was presented in the court on Saturday stated that the Ministry of Law and Justice, government of India, had issued the sanction of prosecution letters and that the relevant record must be received from the Ministry.
