Presents DDA letter to challenge Vinays claim that he was at music programme
While two defence witnesses in the December 16 gangrape case testified on Thursday that one of the six accused Vinay was present at a music programme at the time of the incident,the prosecution produced evidence to prove that no such programme could have been conducted.
Accused Vinay and Pawan had told the court that they were attending a music programme,organised by a church,in a district park at the time of the gangrape. The two witnesses on Thursday corroborated their statement that Vinay was at the event after 8 pm on December 16.
However,the prosecution submitted a letter issued by the Delhi Development Authority (DDA),which stated that it did not allow such programmes to be held in the district park since it was a protected forest area. Further,the letter mentioned that no one was permitted to enter the district parks premises after
7 pm during winter and 8 pm during summer. The prosecution also submitted a list of events organised by the church,which according to Vinay,had organised the programme. The list did not mention any music programme held on December 16.
Vinays neighbour,who deposed on Thursday,said he had seen Vinay playing an instrument at the programme and that his friend had recorded the prgramme on Vinays mobile phone.
On December 19,I had submitted a letter stating that Vinay had been falsely implicated,to the SHO of Vasant Vihar police station. I also sent a copy to the Deputy Commissioner of Police and another to the Human Rights Commission, he said.
A copy of the letter,which the neighbour allegedly submitted at the police station,was presented in court. But the prosecution said the letter should be treated as an exhibit,since it did not bear the seal of any government authority.
