No reservation for state OBC candidate in Central govt job: CAT

The Tribunal passed the order on an petition filed by four members of the Jat community

The Central Administrative Tribunal has held that a person belonging to the state government’s Other Backward Caste (OBC) list but not categorised so by the Centre is not entitled for reservation in central government jobs.

The Tribunal passed the order on an petition filed by four members of the Jat community, recognised as OBC by the Delhi government, seeking appointment in the Employees State Insurance Corporation Limited under OBC list.

The petitioner pleaded before the tribunal that the selection was to be made for Delhi region so the OBC candidates belonging to Delhi and coming under the OBC list of the state should be considered for appointment.

The tribunal, however, refused to grant any relief to them and dismissed their petitions.

“In our considered opinion it would not matter that the recruitment has been made for specific regions including Delhi region for grant of benefit of reservation to the candidates in the OBC list of the Government of NCT of Delhi.

What is material is that the recruitment is being made for an agency of the Central Government,” a bench headed by V K Bali said.
