Notaries to stay off work on April 11

The Notary Association of Gujarat has resolved to abstain from work on April 11 to protest the alleged harassment of notaries.

The Notary Association of Gujarat (NAG) has resolved to abstain from work on April 11 to protest the alleged harassment of notaries.

Ever since a series of land-grabbing incidents were reported in different parts of the state,more than a dozen notaries were subjected to “harassment” and threatened to be arrested by the police on the ground that they had notarised the land documents.

NAG’s Ahmedabad-Gandhinagar zone president Vikram K Mashar said that notaries only saw the documents and not prepared it and hence,they were not responsible for fake land documents that might have come to surface. But policemen probing the land-grabbing cases were booking notaries in the land scams as if they were part of it,he said,adding “this is totally uncalled for.”

Mashar said the Gujarat High Court in 2009 had ruled that no notary could be arrested without following the procedures contained in the Notaries Act,1952.

“To arrest any notary,the police have to take permission of the state legal department,” pointed out Mashar.
