Lt Col RK Sharma of the National Security Guards (NSG), who was supposed to depose in the special sessions court on Tuesday, could not turn up in the court as he has been admitted to a hospital following a complaint of gastroenteritis. The court has re-issued summons for Sharma for November 9.

Sharma was supposed to depose in the court as a court witness but he has been admitted to the NSG Hospital, Manesar, in Haryana, special public prosecutor Ujjwal Nikam informed the court.

The court has, for November 9, called two other NSG commandos — Major Ravindra Prashant — who carried out the operation at Nariman House and Captain Anik Jhakhad who headed the operation at Hotel Taj. It has issued summons to the three under Section 311 of the Criminal Procedure Code (CrPC).

The prosecution did not want to examine the commandos, stating that it would be of a mere academic interest and it could disclose the NSG strategies. The court had observed that it needed to examine them to prove the charge against the accused of waging war against the nation as the evidence produced by the prosecution till now was not sufficient to prove it.
