Two UT Estate officials named in the chargesheet also figure in the Fun-Republic case.

“The chargesheet has been filed against Sub-Divisional Officer (Building) TP Singh, Assistant Engineer Brij Mohan, junior engineers Bipin Kumar, Ram Kumar, Rakesh Kumar and draftsman Vinod Kumar of Estate Office.

The office bearers of the Progressive House Building Society who are named in the CBI chargesheet are UK Batra (Architect), Kuldeep Bhat, Daljeet Arora and Sukhdev Sharma. All the accused will be prosecuted under the relevant provisions of law,” a senior CBI officer said.

While the case was registered against the officials of UT Estate Office and the society in February 2007, it was only after completing its investigation and obtaining sanction for prosecution that the chargesheet was filed in the case.

During the investigation, it was found that the society in collusion with the officials of the Estate Office constructed flats, violating the approved building plans and the relevant rules.

The investigating agency found that kitchen and bedroom areas were more than sanctioned for the project, the height of headway of staircase was less and there were additional/excess projections of balconies on the front and rear portions.

According to the norms, before issuing the occupation certificate the Estate Office officials inspect the site to ensure that the building conforms to the approved building plan.

In the case of Progressive House Building Society project, the Estate Officials, however, did not bring on record certain violations which attracted composition/compoundable fee. Moreover, the construction was also made in violation of the zonal plan and certain flats were required to be demolished as the violations were non-compoundable.
