Panchkula MC: Haryana to move SC

The Haryana government has decided to move Supreme Court to challenge the recent decision of the Punjab and Haryana High court.

Punjab & Haryana High Court has directed to quash a notification for the formation of civic body

The Haryana government has decided to move Supreme Court to challenge the recent decision of the Punjab and Haryana High court to quash the notification for the formation of the Panchkula Municipal Corporation (MC). The government had issued a notification for the formation of seven new municipal corporations in the state, namely Panchkula,Ambala,Yamunanagar,Panipat,Karnal,Rohtak and Hisar.

Although the High Court quashed the notification only on Panchkula, saying that the government had flouted rules in this regard, the Haryana government is reportedly worried that this order may eventually affect the remaining six areas, which are proposed as new municipal corporations.

Since a public interest litigation (PIL) had been filed only in case of Panchkula, the other proposed mnicipal corporations remained largely unaffected.

But there is a fear that similar PILs against other proposed MCs might also affect their fate adversely. Haryana Urban Local Bodies Secretary Raj Kumar had recently written a letter to state Advocate General Hawa Singh Hooda, stating that since the Punjab and Haryana High Court had quashed the notification of the Haryana government to form the Panchkula Municipal Corporation, this decision might also affect the fate of the other municipal corporations proposed to be created in the state.

He sought advice on what should be done,to which Hawa Singh Hooda reportedly said that this was a fit case to file a Special Leave Petition (SLP) in the Supreme Court. The government now wants the AG himself to be present in the Supreme Court and ask the Standing Counsel to file the SLP. The SLP is likely to be filed next week, said sources. A petition has now also been filed to cancel the proposed formation of Yamunanagar Municipal Corporation.

There is resentment in all other areas where the government announced the formation of municipal corporations. In the coming days, more PILs are likely to be filed challenging the notifications in the rest of Haryana, said BJP MLA Anil Vij.
