Clarifying that no relief has been sought against Parsvnath,the Chandigarh Administration today insisted that the three arbitrators should respond to the petition filed by the Administration. Though notices have been finally served to the three arbitrators,all retired Judges of the Supreme and High Court,no appearance was put in by them (arbitrators) nor was any reply filed on their behalf. Senior standing counsel for the Administration Sanjay Kaushal insisted that the arbitrators must respond to contentions raised by the Administration.
A Bench headed Justice Hemant Gupta made it clear that if the respondents (arbitrators) do not respond to the petitions,then they will be proceeded ex parte. In another development,the High Court apprised the UT counsel that the HC has framed new rules for arbitration wherein fees for arbitrators in specific cases have been fixed. The rules,the Bench informed,will be released very soon. Keeping in view the new rules framed by the High Court,the Bench adjourned the case for two weeks.
The High Court had asked the Administration to serve notices to the arbitrators through E-mails. The direction was passed after the Chandigarh Housing Board (CHB) had apprised the Court that notices had not been served to the arbitrators presiding over the case pertaining to the multi-crore rupee Prideasia mega project. The Court was today informed that the notices have finally been served but no response has been received by the arbitrators. The Administration also clarified that no relief has been sought against Parsvnath and that CHB has only objected to the exorbitant fees being charged by the arbitrators.
This submission was made in response to the reply filed by Parsvnath,which had blamed the CHB for delaying the proceedings before the Arbitration Tribunal and fully justified the fees charged by the arbitrators. The development took place during the resumed hearing of a petition filed by CHB,which had moved the High Court against the exorbitant fees charged by the arbitrators. Newsline was the first to report that Parsvnath had attributed malafide to CHB for deliberately delaying proceedings.
