Plea against Swamy: NHRC reserves order

NHRC reserved orders on a complaint filed by a Lok Sabha MP against Subramanian Swamy.

The National Human Rights Commission (NHRC) reserved orders on a complaint filed by a Lok Sabha MP against Janata Party leader Subramanian Swamy for allegedly making anti-Muslim remarks in his article.

Noting that Swamy’s remarks in the newspaper article on July 16 amounted to “poisonous propaganda” against a religious minority and violated several sections of the Indian Penal Code,M I Shanavas,MP from Wayanad district in Kerala,sought the rights body to launch a “thorough” probe. Shanavas also wanted the NHRC to sound out both the Centre and state government if any action was underway against Swamy.

The NHRC,headed by Justice K G Balakrishnan,on Thursday gave a detailed hearing on the petition and reserved its decision.

Arguing for the MP,advocate Harris Beeran,said,“Intervention of the Commission has become necessary to show the world that the system of this nation and its constitutional and statutory institutions cannot tolerate such wicked events.” Beeran argued that remarks in the article primarily amounted to the offence under Section 153 A(1) of the penal code which deals with promoting enmity between different groups on ground of religion.

The lawyer quoted from the petition that the article was “highly communal,lopsided,and parochial of Dr Subramanian Swamy to hold 16 crore Muslims of India to be held responsible for the acts of a microscopic,insignificant and negligible few”. He said: “The above is a clear call for Hindus to unite and fight against Muslims and the statements cited above violate every sacrosanct canon of justice and legal norms.”
