A Petition challenging land acquisition by the Noida Authority in 1976 has been filed in Allahabad High Court. The petitioner has alleged that land was acquired under the urgency clause but was lying vacant till recently when it was given to private builders.
While the petitioner,Liley Ram,has challenged acquisition of 33 bighas,more petitioners from three villages Chaura Saadatpur,Morena and Nithari are preparing to approach the High Court. Liley Ram is a resident of Suthiana village of Gautam Budh Nagar and owned 33 acres of land at Chaura Saadatpur which now stands spread across Sectors 32 and 25-A of Noida.
Kamal Singh Yadav,counsel for Liley Ram,on Thursday said that the Authority was constituted in 1976 and in the same year it acquired land in Chaura Saadatpur,Morena and Nithari villages at the rate of Rs 6 per square yard.
Liley Ram was tenure holder for 33 bighas of land which were acquired. The same land,which had been acquired using the urgency clause in 1976 and had remained vacant,was given to builders at a rate of Rs 1.06 lakh per square metre. We have challenged the acquisition of the land using the urgency clause and change of land use. We are also demanding higher compensation, Yadav said.
He said that acquisition of nearly 1,400 bighas under similar circumstances in the three villages were likely to be challenged by other petitioners. They too have decided to approach the court on the issue of compensation and acquisition and will file their petitions by Friday, Yadav said.
