The Karnataka High Courts verdict quashing an illegal mining case against former Karnataka chief minister B S Yeddyurappa was challenged in the Supreme Court on Wednesday.
Srijan Basha,on whose complaint the Karnataka Lokayukta had registered an FIR against Yeddyurappa, challenged the verdict on the grounds that he was not made a party to Yeddyurapas petition to the High Court against the Lokayuktas decision and that the court passed its judgment on March 7 without hearing him.
He argued that quashing the Governors sanction to prosecute Yeddyurapa was bad in law and impermissible in law and against a catena of judgment and position of law settled by the apex court.
The High Court had,in its verdict, declared as bad in law a chapter in the Lokayukta report that indicted Yeddyurappa in illegal mining, causing his exit as the chief minister.
