An order by a Delhi court to attach the property of two youths of Azamgarh, wanted in the September 2008 Delhi blast case, has been caught in a legal tangle.
Ariz Khan alias Junaid (23) and Shahzad Ahmed (20) are among the eight youths from Azamgarh, who are accused in the case and are yet to be traced.
Ariz’s aunt Anjum Sahar and Shahzad’s grandfather Niyaz Ahmed had moved separate applications before the Additional Chief Metropolitan court Delhi on April 25 against the order for attaching the property passed by the court on April 20. They had also raised objections over the move of the Delhi Crime Branch, which had demanded the attachment of property, stating that the accused do not own the properties at the addresses mentioned in the order.
Magistrate Naveen Arora accepted the applications and asked the Delhi crime branch to verify the documents of the ownership of properties and submit the report before the court by June 4.
Two days ago, the Azamgarh police received a letter (123/ISC-2932, May 16) from Additional Commissioner of Police, Crime Branch, Delhi requesting to verify the documents and send before June 4.
Additional Superintendent of Police (City) of Azamgarh OP Srivastava has been given the task to verify the documents.
Ariz’s uncle Fakhr-e-Alam, whose wife has moved the court, said, “The boy had stayed at our house (Mohalla Baz Bahadur) only for four years, when he was studying here. The police procured the attachment order for our address. Ariz belongs to Nasirpur village, over 20 km away from the Azamgarh city.”
