Punjab Legal Department advises immediate transfer of SSP Mohali

Responding to a legal notice sent by a city lawyer demanding immediate transfer of Gurpreet Singh Bhullar, Senior Superintendent of Police (SSP) Mohali, the Punjab Legal Department has asked the state authorities to consider the immediate transfer of Bhullar, failing which the state may have to face contempt of court.

The legal opinion has been given in response to a legal notice sent by Advocate H C Arora. The lawyer had issued a legal notice to the Punjab government asking it to stop frequent transfers of police officers in complete violation of its rules and a Supreme Court judgment.

In his legal notice, Arora had also mentioned that while some police officers were being transferred too frequently, others were allowed to stay beyond the permissible limit. Arora had stated that he had learnt that certain PPS cadre officers are being continued in their present posting for more than three years. This, Arora stated, was in complete violation of an affidavit filed by Sameer Kumar, IAS, in the High Court.

"Prominent amongst such officers, who have continued in the present place of posting even after the completion of stay of three years, which is the maximum tenure provided under Section 15 of 'The Punjab Police Act, 2007', is Gurpreet Singh Bhullar, SSP SAS Nagar. This conduct on your part also amounts to commission of Contempt of Court" read the legal notice sent by Arora.

Thus, Arora had asked the state authorities to "immediately revoke the transfer orders" of Bhullar and eight more PPS cadre officers. He had submitted that if the orders are not passed he will have to file a contempt petition in the High Court.

To avoid contempt of court proceedings, the Punjab Legal Department has advised the state authorities to consider the immediate transfer of Bhullar.
