Rahul rape case based on ‘non-existent’ claim, says CBI

Congress general secretary Rahul Gandhi told the Supreme Court today that the allegation of his involvement in an abduction and rape case in Amethi was "sinister political mudslinging".

"It is a clear case of sinister political mudslinging and contempt of process of court. Such a petition deserves to be dismissed with cost only and hence the Allahabad High Court order imposing a cost on the petitioner was correct," senior advocate P P Rao, appearing for the Amethi MP, told a Bench led by Justice B S Chauhan.

Rao said the petitioner, former Samajwadi Party MLA Kishore Samrite,

was neither a friend of the victim, nor an acquaintance or relative.

Meanwhile, the UP government also filed its affidavit refuting Samrite's allegation that he had filed the case against Rahul at the behest of UP Chief Minister Akhilesh Yadav and SP chief Mulayam Singh Yadav.

Senior advocate Rakesh Dwivedi said this allegation was not levelled before the HC and its "object was to scandalise the issue so as to gain cheap publicity and to advance his political objectives."

The CBI also adduced its report of its investigation, carried out as per the HC order. The CBI told the court that the case of alleged illegal confinement of the girl and her parents was found to be based on "non-existent" claims since the names and addresses of these persons were false.

The CBI also said Samrite's petition was funded by "some others". It said the websites which Samrite relied on for information on the incident and for filing his petition were located outside the geographical territory of the country.

The court will continue to hear the matter tomorrow.
