Rape call foul, court absolves accused cop

A Delhi court has absolved an Inspector of the charge of attempting to rape a woman when she was in a police station. The court said she might have had ulterior motives in registering a case against him.

Metropolitan Magistrate Dharmender Rana refused to direct police to lodge an FIR against the Inspector on the woman's complaint that he attempted to rape her in the District Investigation Unit cell, Northeast Delhi, in 2011.

The woman has alleged that the Inspector had asked her to remove her clothes on the pretext of noting identity marks on her body. When she took of her clothes, she claimed that the Inspector tried to rape her. After she raised an alarm, her husband who was outside came in and rescued her.

She claimed that she filed a complaint the next day with the DCP of the area.

The DCP's status report said the complaint was baseless and it was made to put pressure on the Inspector to drop several charges in a case registered against the complainant and her family.

After going through the details, the court picked holes in the woman's version of events. It asked why no PCR call was made immediately after the incident and how come she or her family didn't deem it necessary to inform senior officers, who were bound to be present in the DIU cell at the time of the incident?

"The inscrutable silence of the complainant in not reporting the matter to the PCR or the senior officers raises a serious question mark about the credibility of the complainant," the court said.

It said since an FIR had been registered against the complainant and her family, "the inclination on her part to pressurise the officer conducting the investigation could not be ruled out".
