Former Haryana director general of police S P S Rathore will remain behind the bars till July 1,at least. The hearing on his revision petition challenging the enhanced sentence resumed on Tuesday after vacations,but it was again adjourned till Thursday. There was also some confusion as the revision petition was listed for hearing in one court and the bail plea in another. Abha Rathore,wife of the tainted retired IPS officer,today objected to the listing of the bail plea before Justice Rajan Gupta,who before his elevation as High Court judge was senior standing counsel for the Central Bureau of Investigation (CBI) the agency probing Rathores case. In the morning,Abha Rathore requested Justice Gupta to transfer the bail petition to the court of Justice Jitendra Chauhan in whose court the revision petition is being heard. Justice Rajan Gupta,in his response,stated that the court was not seized of the matter and that the bail petitions were not listed for hearing before him. The confusion occurred because the cause list showed the bail petition to be listed for hearing before Justice Rajan Gupta. However,it was later clarified by Registry officials that the same had been cancelled later on. Abha was asked to request Chief Justice Mukul Mudgal to list the bail petition for hearing. She then rushed to Justice Jitendra Chauhan requesting him to take up the bail petition along with the revision petition for hearing. Having received no response,an anxious Abha then went to the Chief Justice. Terming the listing of bail petition by the Registry before Justice Rajan Gupta as hanky panky Abha requested for fresh listing of the plea before some other bench. Showing no conviction,the division bench comprising Chief Justice Mudgal and Justice Ajay Tewari asked Abha to calm down and assured that the bail petition will be listed for hearing on Tuesday itself; the Chief Justice then asked his secretary to list the bail plea. Abha then returned to the court of Justice Chauhan where the revision and bail petitions came up for hearing just after noon. Hearing will resume on Thursday. Abha made repeated requests to the court to hear the case on Wednesday,but the court told her that there are many cases before it and that hearing will resume as and when counsels of all the parties are present. Showing urgency to hear the case,Abha said: I have adjourned all my cases for this case. Neither the act (of molestation) nor anything else has been proved in this case.
