Rocket launcher recovery: Verdict on bail plea today

  • The Vadodara Sessions Court hearing the rocket launcher recovery case, on Monday, reserved its verdict on the bail application of the accused, till November 10.

    Both prosecution and defence argued if bail should be granted to Mushtaq Ismail Shaikh, one of the accused in the case.

    Defence counsel Hanif Shaikh argued that the statement given before the judicial magistrate under Section 164 of CrPC should be allowed at the time of hearing of the bail plea.

    He said this will enable them to know if the statement recorded by the police under Section 161 of CrPC tallies with the confessional statement.

    But Public Prosecutor Bhumika Trivedi argued that since the case has reached an important stage, the bail application should be judged on the merits of the case.

    “Technically, the statement under Section 164 can be considered only when the trial is on.

    At the moment, only the bail application is being heard,” she said.
