RTI Act being misused to settle personal scores: CIC

  • The RTI Act which was enacted to promote transparency in public life is now increasingly being used to settle personal disputes, the Central Information Commission (CIC) has held.

    "Unfortunately, the provisions of RTI act is being increasingly misused by a large number of persons for settling personal and family disputes, including divorce and claim of maintenance related cases," Information Commissioner M M Ansari said while hearing one such petition.

    The Information Commissioner expressed his inability to stop such "frivolous" petitions. "The cost burden of such frivolous petitions has to be borne by the society because we cannot stop them," he said. The issue of misuse of RTI came up while hearing the plea of a Delhi resident I P Aggarwal who sought personal and official details of his sister-in-law Aruna Aggarwal, an employee in the Department of Commerce. Aggarwal was having marital dispute and the information was sought under the backdrop. The department refused to part with the information citing that it was personal in nature. Upholding the view of the department in this regard, Ansari said, "Aggarwal has not given concurrence for disclosure of the submission made by her to the respondent and such records are surely private documents. Therefore, the denial of information is justified."

This guy seems to indicate that the CIC's directive has been effective and efficiently followed all around the country by the respondents (local bodies / authorities etc) from whom citizens ask for information under RTI. A far cry. Each time, I mean each time, the issue at hand is dodged and you get a lousy meaningless bureaucratic crap as a reply aimed at discouraging you from pursuing the questioning. Or there is a counter question! Mr Anna Hazare started this noble cause, thanks to him, but als! he missed the point that a thief is not going to disclose easily all his filthy secrets so easily. I mean to suggest-if a questioner is not satisfied with the answers

Policer offiecer also not give the reply under RTI.please provide me act which i will take legal action against that police officer.for FIR i take the help of court under section 156(2)IPC.please give me reply as earlier posible.

If said government is honest, he/she has no problem in disclosing the information. Indeed, it promotes and advertises their honesty. Police and Income tax departments contain feminists and encourage unscruplous wife to extort money from husband family thus encourage and spread corruption. In my case, Court is not at all looking into any false documents that my wife submitted ..and Police is in support..How many times, I can write complaints about Judge, police and other diplomats with evidences..there is no one listen.. I did have a hope in SIC..but I lost it..but I still fight to get acknowledgement for my sufferings..I dont expect any Justice or relief from any legal forum..they r all for eye wash so that other countries look India as a emerging power. It is truth..Is anybody going file case? Come on I am ready..

    RTIBy: J.M.Manchanda | 26-May-2009 Reply | Forward CIC's inability to stop frivolous and motivated applications under the RTI is unconvincing. The common view is that this Act is being misused in greater measure than the Dowry Prevention Act. One way of preventing misuse is to restrict its usage to those who are an interested party in the matter; have no access to information being sought under normal channels and whose interest is directly and personally affected. Those who wish to acquire information in public interest should resort to PIL.
