Sahara asked to refund booking amount

The district consumer dispute redressal forum has directed Sahara India Parivar to refund Rs 10,004 along with interest at the rate of 8 per cent per annum to a complainant for not giving the possession of a flat in time.

According to the complaint, Bhim Sain, a resident of Rampura Phull in Punjab, booked one three-flat bedroom type-C house in the proposed Swaran/Rajat Yojna (Sahara City Home Township) in Chandigarh in December 2003 and deposited Rs 10,004 as the booking amount. As per the complaint, the officials of Sahara gave a verbal assurance that the possession of the house would be handed over by the end of 2007.

However, the complainant alleged that the company failed to start the construction, and when he visited their office and sought refund, he was put off on one pretext or the other.

He also served a legal notice dated March 6, 2009, seeking refund but to no avail.

On its part, the Sahara India in a written reply denied having floated Sahara Rajat Scheme for providing the housing unit. It has been stated that the complainant misinterpreted the terms and conditions and in fact the scheme provided different opportunities i.e. for purchase of Sahara products to avail different facilities provided by Sahara and also an opportunity for conversion into Sahara City Homes Scheme if the purchaser so desired.

In its reply the company also submitted that the complainant advanced the amount of Rs.10,000 under Sahara Rajat Yojna and not under Sahara City Homes and for the allotment of housing unit, it was compulsory for the person to convert his account into Sahara City Homes.

The forum held the company responsible and asked it to refund amount along with interest
