The Supreme Court on Friday allowed the export of iron ore lying at major ports of Karnataka ever since the state government had issued a ban on its offshore movement in July 2010 following allegations of illegal mining.
An SC bench,however,directed the state government to notify the Karnataka Prevention of Illegal Mining,Transportation and Storage of Minerals Rules by March 31,2011.
The court said that the miners are free to approach the court for interim relief if the state government happens to overshoot the deadline.
The ban on export of iron ore from minor ports of the state will continue.
The state government had on July 26 and July 28,2010 banned the export of iron ore after the appearance of reports of illegal mining.
The Karnataka government has already published the Rules on February 5,2011 to invite objections and suggestions from the public.
Appearing for an iron ore miner,senior advocate K K Venugopal objected that though the public were given 30 days to file objections ,no time-frame was given for considering them.
When told that delay in notification of the Rules would choke the mining industry,Justice Raveendran told Venugopal that the court has to look from the angle of the state and the people. Large quantities of iron ores are disappearing somewhere.
