The Supreme Court today permitted the filing of contempt petition against a noted lawyer for allegedly casting aspersions against some of the judges including the previous Chief Justices of India in an interview to a news magazine.
The issue of seeking criminal contempt was brought up against advocate Prashant Bhushan and Tehelka news weekly in which insinuation against judges including,Justice S H Kapadia,who is next in line for the post of CJI,have been made.
The plea for initiating contempt proceeding against Bhushan was made by senior advocate Harish Salve as the alleged remarks against Justice Kapadia were made in forest matters in which he (Salve) is assisting the court as an amicus curiae.
Bhushan,in the interview,alleged that Justice Kapadia being a member of the Forest bench along with Chief Justice K G Balakrishnan should not have heard the matter relating to Vedanta Sterlite Group as he held shares of the company.
We are not initiating contempt right now. We will seek some steps, the Forest bench,which also comprised Justice Aftab Alam had a few days ago said before granting leave to Salve to file the contempt petition.
Salve said that such statements by the members of the bar were unwarranted.
It was the case where the court should suo motu initiate criminal contempt should be initiated,he said.
The court was told that Bhushan in the interview allegedly made insinuations against previous CJIs also. SC-ADVOCATE 2 LAST Justice Kapadia on Monday had taken strong exception to the remarks made against him.
He had said that while hearing the Vedanta Sterllite matter he has informed the parties about the shares of the company and had expressed his willingness to keep out of the Bench.
