SC reserves order on quotas

  • The SC on Wednesday reserved its order for referring petitions against 27 per cent quota for OBCs in higher educational institutions to a Constitution Bench. The uncertainty over admissions in institutions in the current academic year will, thus, continue.

    The enforcement of the law will also have to wait as the court granted eight weeks for completing pleadings in the matter, which are connected to petitions challenging the constitutional validity of the 93rd Amendment Act and the Central Educational Institution (Reservation in Admission) Act 2006, providing reservations in IIMs and IITs.

    However, there is no bar for the court to consider pleas for vacating its March 29 order staying the implementation of certain provisions of the Act.

    While reserving the order, the Bench comprising Justices Arijit Pasayat and L S Panta asked Solicitor General G E Vahanvati and senior advocate Harish Salve, appearing on behalf of an anti-quota petitioner, to consolidate the various questions raised by the contending parties to be considered by the larger Bench.

    The court said since there was overlapping points, the Solicitor General and Salve were to sit together to make a compilation of differing views and place it before the court on Thursday.
