The Supreme Court on Thursday will hold crucial hearings on the fate of controversial CVC P J Thomas,the issue of black money in foreign banks and bail of former Gujarat Home minister Amit Shah.
While a three-judge Bench led by Chief Justice of India S H Kapadia will decide the legality of the appointment of the embattled CVC,considering his record as an accused in the palmolein import case and allegations against him in the 2G scam,another Bench led by Justice B Sudershan Reddy will hear Solicitor General Gopal Subramanium on the UPA governments stand about revealing names of Indians holding illegal bank accounts in tax havens.
A Bench of Justices Aftab Alam and R M Lodha is set to decide on the twin issues in the Sohrabuddin fake encounter case CBIs appeal against grant of bail to former Gujarat Home minister and chargesheeted accused Amit Shah,and again,the petition by the agency to transfer the trial out of the state,preferably to Mumbai.
The hearing on the issue of black money takes place in the backdrop of the government ruling out disclosure of names of the account holders despite repeated posers from the Supreme Court to explain its reluctance to do so.
Similarly,in the Thomas case,the government has challenged the jurisdiction of the SC to question the appointment,which it contends is outside the courts domain.
Thomas has also seconded the governments contention,adding on his own that he was fit to be CVC. He says he is a tragic victim of a political rivalry which played out in his parent cadre state.
The CBI has sought transfer of the Sohrabuddin trial outside Gujarat,preferably Mumbai,claiming that a fair trial cannot be held in the state due to growing communal atmosphere there.
