  • Reminding the government of its duty to provide special care to reserved category students in higher educational institutions, the Supreme Court on Wednesday ordered IIT-Delhi to reconsider the expulsion of SC/ST students on account of poor performance.

A three-judge Bench of Chief Justice K G Balakrishnan and Justices P Sathasivam and B S Chauhan said the creamy layer principle would not apply to Scheduled Caste (SC) and Scheduled Tribe (ST) candidates. The court said these students deserve additional coaching facilities to help them successfully complete their courses at IITs and IIMs.

“It is not in dispute that SCs and STs are a separate class by themselves and the creamy layer principle is not applicable to them,” the Bench observed. Justice Sathasivam, who wrote the verdict, observed, “These socially and economically backward categories are to be taken care of at every stage even in specialised institutions like IITs.”

The remarks came while the apex court was delivering the verdict in a batch of appeals filed by six reserved category students, including one Avinash Singh Bagri. The students had challenged IIT-Delhi’s decision to expel them for poor performance.

Merit be damnedBy: Avinash Upadhyay | 13-Aug-2009 Reply | Forward We are a nation that time and again indulges in daydreaming about becoming tomorrow's superpower. But we are also a nation that does not recognize that all superpowers give credence to merit, originality and creativity above everything else. A nation that runs on borrowed philosophy and technology does not become a superpower. A nation that places caste, creed, language, nepotism and other extraneous considerations above merit does not become a superpower. We should stop dreaming of being a superpower because we do not display any characteristic of a nation that wants to achieve that distinction.
Laggard need not worry - Porters will be providedBy: niki | 13-Aug-2009 Reply | Forward What kind of judgement is this ? Poor performer is to be carried on the back of teaching institutions ? Due to reservation policy, these guys got admission into the institutes though did not deserev denying rights of much more meritorious candidates and now court advices the institute that these laggards to be carried forward ? What happended to the hardwork which these guys are suppossed to put in ? Moreover by not eliminating creamy layer from the ambit, you will see kith and kin of Lalu / Mulayam / Meera Kumar / Paswan / Boota only advancing - What improvement has it shown to the general S/C, S/T lot despite our having so many politicians coming to power solely on the basis of their caste who only indulged in personal wealth creation. Malaise runs deeper and need to be corrected - these kinds of judgemenst are not the solutions

Simple Academic Wizzards are Useless in real work environment.. ONLY FOOLS THINK INDIA IS A GLOBAL SUPER POWER in reality INDIA IS STILL a 3rd world contry and it will remain so unless these Marginalised sections of society are not Uplifted..JAIBHIM JAIBHARAT
