Scarlett Keeling was not raped but had been given drugs and intoxicants by the accused, according to the chargesheet filed by the CBI last week in the 2008 murder of the British teenager in Goa.

“There was no rape with Scarlett but the accused persons, Samson D’Souza and Plabido Carvalho, had given cocaine lines, beer, other alcoholic drinks and even Ecstasy tablets to her,” the CBI says in its chargesheet after almost 15 months of investigation. “Scarlett was, due to her intoxicated condition, not in position to know what was happening with her and Samson D’Souza was seen outraging her modesty,” the chargesheet adds.

Earlier, the CBI was focusing on rape of the 15-year-old as well. The agency’s findings are not very different from those of the Goa Police. It has blamed the delay in investigations on the rejection of its request for investigation abroad and also on Scarlett’s mother Fiona Mackeown’s initial refusal to come to India.

The CBI filed its chargesheet on October 21 in Children Court, Goa, against D’Souza and Carvalho for culpable homicide (Goa Police had charged them for murder), voluntarily causing hurt, outraging the modesty of woman (Goa Police chargesheeted them for rape) and destruction of evidence. The CBI recorded the statements of more than 200 witnesses and experts.

Scarlett’s semi-nude body was found on Goa’s Anjuna beach early on February 18, 2008. After the police probe, the CBI was handed over the case on June 5, 2008.

The CBI found that “on the evening of February 17, 2008, Scarlett and her intimate friend Ruby Caso took two beer bottles from Bean Me Up restaurant. After a while, Ruby and Scarlett visited Primrose Bar and also Nine Bar Restaurant in Vagator and a restaurant in Baga beach.” They had returned to Bean Me Up at 12.30 am. “Scarlett came to the room of Ruby Caso to bid good-bye to her as she was leaving India early morning. She also borrowed some money from Ruby Caso a taxi ride. Then Scarlett left Bean Me Up restaurant to proceed to her accommodation at Siolim,” the CBI says.
