School told to pay Rs 75,000 to student for withholding his exam admit card

The Delhi state consumer forum has asked a school to pay a compensation of Rs 75,000 to a student for the "mental agony, harassment and sheer suffering" caused to him after the school failed to supply his admit card and roll number for the Class XII CBSE Board exams.

The bench has also asked the Delhi government to take action against the school.

"Let a copy of this judgment be sent to Director of Directorate of Education, Government of NCT of Delhi, to initiate proceedings for cancellation of recognition/affiliation of Bal Mandir Senior Secondary School, Vikas Marg, and inform the state commission," the bench comprising Member (Judicial) V K Gupta and Member S C Jain said.

The bench passed its order on a plea by East Delhi resident Shyam Sunder Aggarwal.

Aggarwal in his petition said the school had withheld his son's, Akash Aggarwal, admit card, in 2009, and even failed to inform them about it as Akash had missed several classes as he was suffering from dengue.

Aggarwal said on February 27, 2009, when his son approached the school principal for the admit card, he was told that the CBSE had refused to issue it as Akash's attendance was 68.6 per cent and that, according to CBSE rules, it should be at least 75 per cent.

Aggarwal further said that in an RTI reply, the CBSE had said on February 11, 2009, that it had asked the school why recommendations were not made for condoning the attendance shortage of 13 students, including that of Akash.

The CBSE, however, had later agreed to condone the attendance and had issued admit card to the boy.

Noting that "all medical certificates had been submitted much in advance to the school and it was the duty of the school to forward all these documents to CBSE for condoning the shortage in attendance," the consumer forum held that "the admit card was not deliberately delivered to Akash Aggarwal."
