    Law minister Moily says anti-gay law was a tool of exploitation.

    In what could be another indicator of fresh thinking within the UPA government on the issue of changing the anti-gay law in the country, Union Law Minister M Veerappa Moily on Sunday admitted that Section 377 of the Indian Penal Code (IPC), which bars same-gender sexual relations, had been misused in the past.

    He said the law should not become an instrument of exploitation of homosexuals by authorities in future.

    Asked why the Central government had not sought a stay on the Delhi High Court judgment that struck down portions of the Section 377 that criminalised same-gender, consensual sex, Moily said it would have been “preposterous”, as it was an important question of law in relation to Constitutional rights of liberty and privacy.

    Speaking to Karan Thapar on CNN-IBN’s Devil’s Advocate, Moily said, “There would be occasions when the government would not seek to reverse a judgment...This (Section 377) is one such provision that has a tendency of misuse and exploitation and has been misused...One thing must go to the credit of the Delhi High Court judgment. It is well-documented, well-researched, well-argued.”

    ...By: divya | 24-Oct-2009 Reply | Forward India is still not a fertile ground for sec 377's application coz one night stands are considered immoral but i feel that its a persons own choice of opting a way of living a person is a creation of god and this type of nature is not self built in them... it is completely natural for a man to have feelings for another man and not of his own personal choice. because we have a straight sexual orientation does not mean putting a bar to another and i am glad to see that people are here in india who realize the need and the urgency to legalize it as soon as possible even our own constitution grants us the rt to livelihood and the rt to liberty why does this question have to arise that the gays do not have the rts to do all what a homo sapien does... !! this is unjustice and talking about westernisation y not india is a developing nation and shud look up to countries to match with.. then only india will prosper... and in the end i conclude by saying LIVE AND LET LIVE.

It's all right that little girl children should be butchered as soon as they turn 2 days old. It's all right when women are not allowed to go to school or vote. Will you sit back and think about population growth and global warming or go and report the matter to the police? When it comes upon ones own self, every issue is important. Ask that women who is beaten by her drunk husband. Tell her, darling why don't think about who should form the government or other important matter. She'll have a better answer for you.

Moily ji has actually stood up for tolerance -- that great Indian value that none of the other commentators to this article think is vital at all. Standing up for everyone's rights is not fishy. It is the law. And it is Indian culture. Remember, it was Shikhandi who helped the Pandavas win the Mahabharata war fighting on the side of dharma. Moily ji is also standing up for dharma against the adharma of violence and exploitation by the police. Of course, he is informed with FACTS that none of the other commentators here are. If any of the above commentators have been raped or assaulted by the police merely for being gay (as is the case in India today), let them stand up and call this statement "outrageous".
