Home Minister Sushil Kumar Shinde on Monday ordered a probe by the National Investigation Agency (NIA) into the arrest of alleged militant Syed Liyaqat Ali Shah.
The case is being transferred to NIA, Shinde said. The home ministry said there were some doubts about the Delhi Polices report, which were being examined independently.
Delhi Police have claimed Shah is a Hizbul Mujahideen terrorist who planned to attack the city. They have said he was arrested on the basis of specific intelligence inputs.
But Shahs family has said he was arrested on the Nepal border last week, while he was on his way from PoK to the Valley as part of the J&K governments rehabilitation policy for surrendered militants.
The NIA will also probe the alleged seizure of arms and explosives from a guest house in Old Delhi.
However,Delhi Police commissioner Neeraj Kumar, who met union home secretary R K Singh, said: I am not aware whether the probe is being handed over to NIA or not. It was purely a Delhi Police operation and we stand by our investigations.
