Sohrabuddin case: Court rejects plea for narco test on accused

  • The Metropolitan Court on Wednesday rejected an application by the CID (Crime), seeking permission to conduct narco-analysis test on seven police personnel accused in the Sohrabuddin fake encounter case. The seven include Dy SP M L Parmar, ATS PSI N V Chauhan, Inspector Balkrishna Chaubey, Dy SP (ATS) N K Amin and Rajasthan police personnel Abdul Rehman, Himanshu Singh and Shyam Singh.

    Chief Metropolitan Magistrate K J Upadhyay rejected the application, saying a narco-analysis test cannot be conducted without the consent of the accused. The application was also rejected on the basis of Article 20(3) of the Constitution, which gives a person the right against making statements incriminating himself.

    Earlier, while seeking permission to conduct the test, the prosecution had submitted in the court that the accused did not say anything during their remand period and they were aware of provisions of law under which a narco-analysis test could be conducted. It had further submitted that the tests were necessary for further investigation in the case.
