  • The transferee also needs to obtain a No Objection Certificate (NOC) from the registering authority. The transfer would be complete only when the ownership is entered in the records in the name of the transferee.

    “When the present case is viewed in the light of these provisions, it is clear that the vehicle had not been transferred to Om Parkash. The transfer of ownership has not been reported to the registering authority either by the complainant or the transferee. The NOC was also not obtained. The complainant, therefore, is still the owner of the vehicle in the records of the registering authority,” the forum said.

    “The vehicle was insured and has been stolen. It is necessary for the company to pay the compensation to its owner,” the forum ruled.
