Facing court martial in the Sukna land scam case,Lt Gen P K Rath on Wednesday filed a petition in the Armed Forces Tribunal (AFT) alleging there was “malafide” intention as the Eastern Command had initiated action against him only after he was designated the Deputy Chief of Army.

Rath’s counsel Ajit Singh said the petition filed on Wednesday was along the same lines as the one filed in the High Court which had been rejected it on the jurisdiction issue.

In his petition before the High Court here,Rath had contended that he had been singled out in the case and the “offence” against him had been “prejudged”.

The Eastern Command,headed by Army Chief-designate Lt Gen V K Singh,had initiated the Court of Inquiry against Gen Rath after the Cabinet Committee of Appointments had approved his elevation as Deputy Chief of Army Staff,Rath said in his petition.

The petition had said that the order to attach him to the Kolkata-based headquarters just before he could take over as Deputy Chief of Army was “highly discriminatory,arbitrary and hence bad in law.”
