A day after the Delhi Electricity Regulatory Commission (DERC) alleged that BSES had forged documents presented as evidence in the ongoing tariff hike case, the discom questioned the validity of the Multi Year Tariff Order at the hearing on Wednesday. The case was filed with the Appellate Tribunal of Electricity in February this year after the DERC passed the MYT order that fixes tariff.
“The order itself is not sustainable under any law as the chairman of DERC is not permitted to use his casting vote to pass the MYT order, as was the case,” a senior BSES official said. The hearing was adjourned after two hours without the Tribunal reaching any decision, and will continue on Thursday.
DERC sources said BSES has agreed to not rely on the fresh documents as evidence. “As mentioned in our affidavit, the documents are on the face of it not genuine,” a senior DERC official said.
The discom says this is “absolutely untrue”. While refusing to respond to allegations made by the DERC, a BSES official said, “If any document can ensure that we are on the right side of the law in this case, we will use it. At this stage, we are not withdrawing any evidence.”
Most experts do not see a quick decision: “The case could drag on with daily hearings for a few months at least.”
