UDD officials face threat to life if given bail,CBI tells court

Opposing the bail application of the three Urban Development Department officers arrested in the Adarsh missing file case,the CBI on Wednesday told the court that the accused may face a life threat if given bail. The court sent the trio in judicial custody till June 1.

According to the agency,the three could face a threat to their lives as many ‘influential bureaucrats and politicians’ were involved in the Adarsh scam. The defence told the court the accused were government servants and posed no threat of absconding. They also said since the material evidence recovered was in the custody of the CBI,the question of tampering with it does not arise. “During the 13-day custody,the CBI has not been able to recover the notings from me nor have they been able to make out any case against me,” said defence lawyer Satyavrat Joshi on behalf of town planner N N Narvekar,one of the accused.

CBI counsel Kavita Patil told the court that the accused were not cooperating in tracing the missing hard disk of one of the computers used in preparing a note-sheet of the building.

On Monday,the CBI had secured a three-day custody claiming that nine computers were identified at the instance of the accused in Mantralaya and one of the hard disks have gone missing. According to the CBI,these computers were used for the preparation of various notings and correspondence relating to the subject matter and another computer was found without a hard disk. Investigations are on to find the hard disk or back-up of the missing hard disk. The recovered hard disks are to be sent for forensic analysis.

On May 5,the CBI arrested NN Narvekar,UD desk officer Gurudatt Wajpe and Waman Rawool,the then clerk to the UD principal secretary. The missing papers allegedly contained important information on the reduction of the width of Captain Prakash Pethe Marg at Colaba and the alleged Coastal Regulation Zone (CRZ) clearance given to the land on which Adarsh stands. According to the remand application,the relevant file pertaining to Adarsh moved between different government departments from 1999 to 2003.

According to the CBI,it was during Wajpe’s tenure as a desk officer that the file had suddenly reappeared after going missing in 2003. However,vital papers that had notes by bureaucrats were missing from the file. The remand application states that on the direction of the UD principal secretary a search for the file was conducted on October 27,28 and 29,but the file was untraceable. On November 1,2010,at the instance of Wajpe,a clerk again searched the cupboard,and surprisingly,the file had appeared,but without the notes,the prosecution stated.
