UT put on notice on VAT Tribunal appointments

The Punjab and Haryana High Court on Monday put the UT Chandigarh Administration on notice, while acting on a petition seeking appointment to the post of chairman and members of UT Chandigarh VAT Tribunal in consultation with the high court.

Kumar Jain issued notices to UT Chandigarh and the advisor to the administrator for April 3.

Lawyer H C Arora had filed the petition seeking issuance of directions to the respondents to make appointment to the post of chairman, at present occupied by the UT Advisor, and three posts of members of the UT Chandigarh VAT Tribunal only in consultation with the High Court of Punjab and Haryana.

The court was informed that the UT Chandigarh VAT Tribunal being a quasi-judicial tribunal and being under the superintendence of the Punjab and Haryana High Court, the appointments to its posts of chairman and members could not be made by UT Administration, without consulting the Punjab and Haryana High Court.
