    Moily says govt will examine the judgment by Delhi HC before taking any decision.

    As the Delhi High Court legalised gay sex among consenting adults, the Government on Thursday said it will examine the judgment in detail before taking any decision. "We need to examine the details of the judgment. Let me examine it," Union Law Minister Veerappa Moily told reporters.

    In a landmark judgment, the Delhi High Court legalised gay sex among consenting adults holding that the law making it a criminal offence violates fundamental rights. The controversial law on homosexuality goes back 149 years when Lord Macaulay introduced the section in Indian Penal Code punishing carnal intercourse holding it was against nature.

    The Section 377 says, "Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine."

The first one is what is there for the government to consider and decide on this matter when the Court has made a verdict? The High Court has decreed that it is not a mental disorder. Apparently, it recognizes the biological reasoning of the affected population. At the most it could do is to appeal to the Supreme Court to over rule the decision. For too long, religious leaders have used their clout to enforce their will on individuals and the political leadership has succumbed to their pressure. There is no argument that conventions and social order should not be floundered to make way to accommodate this biological necessity. Individuals concerned MUST maintain discretion in respect of public display of affection and should not attract undue attention of children whom we want to raise according to established social norms.

    Government will examine the judgement on homosexuality by Delhi High CourtBy: Premangsu Chowdry | 02-Jul-2009 Reply | Forward The statement by the Minister of Law may delay ,and ultimately shelve repealing of the IPC 377 which remained only on paper, except when it came to light in cases of rape, for 143 years. This practice of thousands of years across different societies and religious beliefs all over the world , born out of certain inherrent physiological and psychological factors ,cannot be wiped out by any law. The dictats of certain religious heads may well be perceived by those enlightened, as self-deception; at the best, as attempts to consolidate the hold over their 'flocks' , and inject religion into politics in our secular land we are so proud of.

This section 377 should not be scraped. It will certainly have a catastrophic effect on our new generation. We all should uphold our holy indian culture.Wonder why Mr. Moily is more keen on this silly issue. It would better if he puts sincere efforts to give solutions more other serious issues in the society.Save India...Jai Hind
