Were in Metro at time of Sunday violence: Arrested duo to court

Two of the eight men arrested for unlawful assembly and rioting last Sunday at India Gate have told a city court that they were travelling in the Metro at the time of the incident.

Kailash and Amit Joshi told the court of metropolitan magistrate Navita Kumari that they had been "picked up" by police on "false" charges. Their counsel Somnath Bharti has asked the court to call for video footage from Rithala and Rajiv Chowk metro stations to verify their claim.

"They used their Metro smart cards to travel in the Metro. We have asked the court to issue directions to police and DMRC to preserve CCTV footage from 3 pm to 6 pm," Bharti said.

The court has asked DMRC and police to reply to the plea of the two brothers. "Issue notice to the SHO and the DMRC for December 27," the court said.

Eight persons were arrested by police under an FIR for unlawful assembly and rioting. The court had granted bail to all eight on Monday. Four persons were unable to furnish surety then. While three appeared in court on Wednesday with surety, one Nafis Ahmad has still not been released since he failed to provide surety.

"He is a very poor man who works as a mechanic in Inderpuri. He does not have any close relative in Delhi. A cousin, who has been asked to act as surety, is very scared of police," Bharti said. The court has granted him time till December 28 to furnish surety.

Asked about the arrests, Delhi Police spokesperson Rajan Bhagat said: "These men have been arrested in the course of the investigation but they are not the persons charged for the murder of the constable. Investigations are currently underway to find out who are the persons responsible for that crime."
