
Ajmal Kasab’s dramatic confession leaves out several charges against him, the Mumbai Police and the prosecution in the 26/11 terror attacks trial said on Monday as they geared up to draw the court’s attention to these “important omissions”.
In mid-February, Kasab had given a confessional statement before Additional Chief Metropolitan Magistrate R V Sawant Waghule under Section 164 of the Criminal Procedure Code (CrPC). Compared to that statement, Kasab has “conveniently omitted” details in his fresh admission in an attempt to lessen the blame on him, the Crime Branch alleged.
“He has already given a confessional statement before another magistrate. In his admission today, Kasab has conveniently omitted important details of his role in certain incidents such as the murder of policeman Tukaram Omble. If the court accepts his confession on Tuesday, we will draw the court’s attention to the facts left out,” said Joint Commissioner of Police (Crime) Rakesh Maria.
“Kasab has admitted to his presence during the incidents at CST, Cama Hospital, Rang Bhawan Lane, and Girgaum Chowpatty but has made an attempt to show that he played a lesser role than Abu Ismail. This is not true at all,” said Maria.
In his four-hour-long confession before Judge M L Tahaliyani, Kasab said he had not fired a single round after he and Ismail stepped outside CST, where 52 people had been shot. “I fired only inside the station. I was acting on Ismail’s orders. He was the leader of the group,” Kasab told the court.
However, according to the chargesheet, it was Kasab who had pressed the trigger of his AK-47 rifle and murdered Omble when intercepted at Girgaum Chowpatty. The prosecution has witnesses.
